Residents of five states will ring in the new year with the best gift of all: new privacy rights.

This coming January will see consumer privacy laws enacted by state lawmakers in 2023 and 2024 go into effect in Delaware, Iowa, Nebraska, New Hampshire, and New Jersey. It will bring the number of countries with privacy laws to 13.

These new rules guide the way certain types of businesses operate– its scope varies by country – it captures consumer information and gives citizens of those countries the right to know, correct, and delete the information businesses have. Here are some of the key points in the new set of rules:

Delaware

Originally enacted in 2023, the law applies to individuals and organizations that, in the previous year, analyzed the personal information of 35,000 Delaware residents or changed the personal information of 10,000 Delaware residents and made more than 20 percent of their revenue through sales. about your information.

Unlike most other federal privacy laws, it applies to both nonprofits and for-profit businesses.

It gives citizens the right to access personal information that an organization has about them, obtain a copy of that information, correct it, and stop it from being used for advertising, sold to a third party, or used to make automated decisions. and legal requirements.

The law will come into effect on January 1.

Iowa

Also passed in 2023, the Iowa law applies to businesses that process the personal information of at least 100,000 people or that analyze the personal information of 25,000 residents and make more than half of the revenue from those sales.

It is a less restrictive, more business-friendly law than many other federal laws that have been in effect.

Although consumers are given the right to access and remove information that a business has about them and opt out of having it sold to another, they are not allowed to correct their information, stop using targeted advertising, or opt out. it is used to make decisions automatically about them.

The law will come into effect on January 1.

Nebraska

The government’s data privacy policy has no real revenue or customer base. It also applies to any business that is not a small business, as defined by the Federal Small Business Act (and also applies to small businesses that sell branded products without obtaining a consumer’s license).

It gives consumers the right to access, correct, and delete personal information held by businesses and to stop that data from being used for targeted marketing, third-party marketing, or other decision-making processes.

The law will come into effect on January 1.

New Hampshire

The law applies to businesses that process the personal information of 35,000 Granite Staters or that process the personal information of 10,000 Granite Staters and generate 25 percent of their gross revenue from the sale of these products.

It gives citizens the right to access, correct, and delete personal information held by relevant businesses and opt out of data being used for targeted advertising, sold to third parties, or used in other decision-making systems.

The law will come into effect on January 1.

New Jersey

The law applies to businesses that process the information of at least 100,000 individuals (unless the processing is for the purpose of completing a payment) or businesses that analyze the information of 25,000 individuals and benefit from marketing or information.

Like many of the previously mentioned laws, it provides consumers with the right to access, correct, and delete personal information and the right to opt out of data being used in marketing, sold to third parties, or used for automated decision-making processes.

However, it may also allow consumers to indicate that they wish to opt out of what is known as the global option. Although not defined in legal terms, a global opt-out mechanism could be a browser extension that informs each website a user has visited of their privacy choices, rather than the user communicating those choices to each business individually.

The law will come into effect on January 15.
